Toronto garden suites: an example of why site review matters
Toronto currently permits garden suites in many residential zones, subject to its zoning standards and Building Code access requirements. The City also warns applicants to consider protected trees and recommends zoning review. Other Ontario municipalities use their own planning rules, so Toronto’s standards should not be copied to another city.
Common garden-suite questions
Can I build a garden suite in any backyard?
No. Local zoning and the physical property must support the proposed detached dwelling unit.
Does a garden suite need emergency access?
Yes, applicable Building Code access requirements must be satisfied. This can be a decisive site-feasibility issue.
Can the suite be two storeys?
That depends on the municipality’s current height, setback and other zoning standards and the specific property.
Will trees affect the permit?
They can. Protected trees and the space needed for tree protection can reduce or alter the buildable area.
Can I use a pre-approved Toronto garden-suite plan?
Where eligible, Toronto’s pre-approved plans can simplify the building design, but a site-specific building permit and compliance review are still required.
Should I order full drawings before checking zoning?
No. A feasibility/site review first can prevent spending design time on a building envelope that the property cannot support.
After permit issuance
The garden suite must be built in the approved location and to the approved drawings. Site changes involving access, servicing, grade, trees or building location can affect both permit and zoning compliance and should be reviewed before construction proceeds.
